TERMS OF SALE:  The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance.  If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement.  In the event said purchaser fails to make said 5% deposit by 3:00 p.m. on the date of the sale, the Special Referee shall re-sell the mortgaged premises on the same sales date at 3:00 p.m., upon the same terms and conditions.
As a deficiency judgment is being waived, the bidding will not remain open thirty (30) days after the date of sale.  The United States of America Acting through the U.S. Small Business Administration has a one year right of redemption from the date of sale, unless it waives its right of redemption. If the successful bidder fails or refuses to make the required deposit, or comply with his bid within thirty (30) days, then the property will be resold at his risk.  Purchaser to pay for preparation of deed, documentary stamps on the deed, and recording of the deed. NOTICE IS HEREBY GIVEN that an action will be commenced in this Court upon the Complaint of the above-named Plaintiff against the above-named Defendants for the foreclosure of that certain Mortgage of Real Estate given by Nancy C. Davis a/k/a Nancy Carolyn Greene, now deceased, to the Plaintiff, its successors and assigns, dated December 11, 1990, and recorded on December 11, 1990, in the office of the Clerk of Court for Barnwell County, South Carolina in Book 151 at Page 267 (the “Mortgage”).
At the time of the filing of this notice, the premises affected by the said action were situated in the County of Barnwell, State of South Carolina, and are described as follows:
All that certain piece, parcel or tract of land, with improvements thereon, situate, lying and being East of the town of Williston in the Williston School District, County of Barnwell, State of South Carolina, and containing 0.977 acre as shown on plat prepared for Nancey Davis by Luther Lee Lown, R.L.S., dated August 22, 1990, revised September 21, 1990, and recorded December 11, 1990 in Plat Cabinet A, Slide 77, Page 7, in the office of the Clerk of Court for Barnwell County. Reference to said plat is hereby craved for a more complete description of said property.  Be all measurements a little more or less.
This being the same property conveyed to Nancy C. Davis by deed of Joe B. Owens dated December 11, 1990 and recorded December 11, 1990 in the Office of the Clerk of Court for Barnwell County in Book 151 at page 262.
