A Blackville couple is facing assault and kidnapping charges after allegedly taking their niece without permission.
On Dec. 27 around 8 p.m., Amy Lynn Mitchell, 31, went to a Monarch Road home in Williston asking for her sister's two-year-old child, according to a Barnwell County Sheriff's Office incident report. The child was being watched by a babysitter.
The babysitter told deputies Mitchell tried to grab the child and "when she didn't give the child to her she (the babysitter) was assaulted." The babysitter's sister tried to intervene, but Amy Mitchell's husband, 30-year-old Wesley Williams Mitchell, jumped on her and threw her to the ground, states the report.
The Mitchells drove away with the child, but later stopped after a deputy called Amy Mitchell and convinced her to stop.
Deputies arrived at the location where the Mitchells parked and found the couple and four children, all under age 13, in the backseat with no restraints. The report states the couple had been drinking and Wesley Mitchell was driving with a suspended license.
Both are charged with kidnapping and assault and battery.
Amy Mitchell told deputies she went to the babysitter's house to pick up her sister's child, but could not explain why, according to the report.
The child's mother told deputies her sister and brother-in-law did not have permission to pick up her child. This was also evidenced in text messages Amy Mitchell showed deputies between her and her sister, the child's mother. The messages stated "the babysitter was dependable and for her child to stay there and for Amy not to bring her child out in the cold weather conditions," according to the report.
The Mitchells were released to the Barnwell County Detention Center while the children were picked up by relatives.
